Code § 10-1053.01","heading":"Public Restroom Facility Program.","body":"(a)\nThere is established within the Department of Public Works (\"DPW\") the public restroom facility program.\n\n(b)\n(1)\nDPW is authorized to enter into a contract to provide public restroom facilities, which shall:\n(A)\nBe compliant with the Americans with Disabilities Act of 1990, approved July 26, 1990 (104 Stat. 327; 42 U.S.C. § 12101 et seq.);\n(B)\nHave running water for flushing toilets and sinks, but not require a municipal water connection;\n(C)\nHave the ability to be relocated at the direction of the Director; and\n(D)\nHave remote monitoring and the ability to program automated hours of operation.\n(2)\nThe contractor shall:\n(A)\nProvide 24-hour-per-day full maintenance and service for each public restroom facility;\n(B)\nCollect data and provide reports to DPW at least monthly on:\n(i)\nPublic restroom facility usage by date and time;\n(ii)\nIncidents of misuse or vandalism;\n(iii)\nHow facilities were accessed;\n(iv)\nCleanliness; and\n(v)\nUser experience; and\n(C)\nInstall public restroom facilities in locations prescribed by the Director.\n\n(c)\nSubject to funding, the Director shall designate the initial placement of public restroom facilities:\n(1)\nWithin 500 feet of the following locations:\n(A)\nDupont Circle Park;\n(B)\nColumbia Heights Civic Plaza in Square 2843;\n(C)\nAlethia Tanner Park;\n(D)\nThe intersection of Bladensburg Road, NE, and Maryland Avenue, NE;\n(E)\nEastern Market Metro Plaza in Square 901S; and\n(F)\nThe intersection of T Street, NW, and 7th Street, NW; and\n(2)\nWithin the boundaries of:\n(A)\nOxon Run Park;\n(B)\nWatkins Recreation Center;\n(C)\nThe Downtown DC Business Improvement District; and\n(D)\nMarvin Gaye Park.\n\n(d)\nThe Director may relocate a public restroom facility, including those initially sited pursuant to subsection (c) of this section, at the Director's discretion.\n\n(e)\nIn selecting locations for new public restroom facilities, the Director shall first prioritize sites identified in the report issued pursuant to § 10-1052(b).","path":["Title 10.
