To see the current law (including emergency and temporary legislation, if relevant) click this link: Current Version*\n  \n\n(a)\nThe Department of Public Works (\"DPW\") shall establish a pilot program to provide public restroom facilities by contract with a company that provides those services.\n\n(b)\nWithin 30 days after October 1, 2023, the Mayor shall solicit bids from companies to provide public restroom facilities in the District.\n\n(c)\nPursuant to the solicitation provided for in subsection (b) of this section, DPW shall enter into a contract for 12 months with a company that is able to:\n(1)\nPlace at least 5 public restroom facilities in the District of Columbia that:\n(A)\nAre compliant with the Americans with Disabilities Act of 1990, approved July 26, 1990 (104 Stat. 327; 42 U.S.C. § 12101 et seq.);\n(B)\nHave running water for flushing toilets and sinks, but do not require a municipal water connection;\n(C)\nAre portable; and\n(D)\nHave remote monitoring and the ability to program automated hours of operation;\n(2)\nProvide 24 hour per day full maintenance and service for each public restroom facility; and\n(3)\nCollect data and provide reports to DPW at least monthly on:\n(A)\nPublic restroom facility usage by date and time;\n(B)\nIncidents of misuse or vandalism;\n(C)\nHow facilities were accessed;\n(D)\nCleanliness; and\n(E)\nUser experience.\n\n(d)\nThe 5 public restroom facilities should initially be placed\n(1)\nWithin 500 feet of the following locations:\n(A)\nDupont Circle;\n(B)\nColumbia Heights Civic Plaza; and\n(C)\nThe intersection at H Street and 8th Street, NE; and\n(2)\nWithin the boundaries of:\n(A)\nOxon Run Park; and\n(B)\nThe Downtown DC Business Improvement District.\n\n(e)\nThe Director of DPW may change the location of a public restroom facility placed pursuant to subsection (d) of this section at his or her discretion.\n\n(f)\nThe Mayor, pursuant to Chapter 5 of Title II, may issue rules to implement the provisions of this section.\n\n(g)\nWithin 1 month after the completion of the pilot program, DPW shall provide information to the Council and the Mayor that includes:\n(1)\nTotal cost of the program, and a breakdown of those costs;\n(2)\nMonthly facility usage rates for each facility;\n(3)\nData related to how customers accessed the facilities;\n(4)\nAny incidents of misuse or vandalism; and\n(5)\nData related to user experience.","path":["Title 99.
