Code § 16-5607","heading":"Motion for judicial relief.","body":"(a)\nA motion for judicial relief under this chapter shall be made to the Superior Court.\n\n(b)\nOn motion of a party, the Superior Court may compel arbitration if the parties have entered into an arbitration agreement that complies with § 16-5605 unless the court determines under § 16-5612 that the arbitration should not proceed.\n\n(c)\nOn motion of a party, the Superior Court shall terminate arbitration if it determines that:\n(1)\nThe agreement to arbitrate is unenforceable;\n(2)\nThe family law dispute is not subject to arbitration; or\n(3)\nUnder § 16-5612, the arbitration should not proceed.\n\n(d)\nUnless prohibited by an arbitration agreement, on motion of a party, the Superior Court may order consolidation of separate arbitrations involving the same parties and a common issue of law or fact if necessary for the fair and expeditious resolution of the family law dispute.","path":["Title 16.
