Code § 39-205.04","heading":"Large capital grants program.","body":"(a)\nThere is established within the Commission a Large Capital Grants program to provide subgrants to eligible organizations for the purpose of funding large capital grants for facility improvements in an amount exceeding $900,000 per grant.\n\n(b)\nEligibility for a large capital grant shall be limited to organizations that:\n(1)\nOwn the facility to be improved in fee simple, or hold a lease the facility to be improved on a long-term basis of greater than 30 years; and\n(2)\nUse the grant to improve a facility with a real property tax assessment of $1 million or more.\n\n(c)\nAn organization awarded a large capital grant pursuant to this section shall not be eligible for a grant to fund capital projects pursuant to § 39-205(c-1)(2)(A)(i) in the same fiscal year.\n\n(d)\nAn organization awarded a large capital grant pursuant to this section shall not be eligible for a large capital grant for two subsequent fiscal years.\n\n(e)\n(1)\nThe Commission, pursuant to subchapter I of Chapter 5 of Title 2, shall issue rules to implement the provisions of this section. Such rules shall set forth eligibility and disbursement requirements in addition to the requirements set forth in subsection (b) of this section.\n(2)\n(A)\nBy November 1, 2023, proposed rules for implementation of this section shall be submitted to the Council for approval.\n(B)\nIf the Council does not approve or disapprove the proposed rules submitted pursuant to subparagraph (A) of this paragraph, in whole or in part, by resolution within a 60-day period that commences on the date of their submission to the Council and excludes days of Council recess, the proposed rules shall be deemed approved.\n(C)\nThe Commission may not advertise or award any grants under this section until the Council has approved the proposed rules in whole or in part or the proposed rules are deemed approved pursuant to subparagraph (B) of this paragraph.\n\n(f)\n(1)\nNotwithstanding any other provision of this section or part B of subchapter XII-A of Chapter 3 of Title 1, from the funds appropriated for the Large Capital Grants program, the Commission shall issue the following grants:\n(A)\nIn Fiscal Year 2025:\n(i)\n$4 million to the National Theatre, for the acquisition of and repairs to the theater;\n(ii)\n$500,000 to the Howard Theatre, for debt service payments related to renovations and improvements to the theater and operational expenses of the theater; and\n(iii)\n$285,000 to the Lincoln Theatre, for repairs to and renovation of the theater; and\n(B)\nIn Fiscal Year 2026:\n(i)\n$500,000 to the Woolly Mammoth Theatre Company, to pay for operational expenses of the theater; and\n(ii)\nTo Grupo de Artistas Latinoamericanos, G.A.L.A., Inc., also known as the GALA Hispanic Theatre (\"GALA\"), for capital repair and expenses for renovation to, and operation of, the theater:\n(I)\n$450,000 to be disbursed in a lump sum by December 31, 2025; and\n(II)\nUp to a maximum of $50,000, $1 for every $1 raised by GALA from non-government sources, as evidenced by a notarized, itemized list of donations submitted by GALA to the Commission:\n(aa)\nDuring the period from August 1, 2025, to October 31, 2025, to be disbursed in a lump sum not later than December 31, 2025;\n(bb)\nDuring the period from November 1, 2025, to January 31, 2026, to be disbursed in a lump sum not later than February 28, 2026;\n(cc)\nDuring the period from February 1, 2026, to April 30, 2026, to be disbursed in a lump sum not later than May 31, 2026; and\n(dd)\nDuring the period from May 1, 2026, to July 31, 2026, to be disbursed in a lump sum not later than September 30, 2026.\n(2)\nAny appropriated amounts remaining in the Large Capital Grants program after accounting for the maximum amounts required to be issued pursuant to paragraph (1) of this subsection in a respective fiscal year shall be awarded competitively in accordance with subsections (a) through (e) of this section.","path":["Title 39.
