Code § 42-1651","heading":"Powers and duties of receiver.","body":"(a)\nExcept as limited by Superior Court order or law of the District other than this act, a receiver may:\n(1)\nCollect, control, manage, conserve, and protect receivership property;\n(2)\nOperate a business constituting receivership property, including preservation, use, sale, lease, license, exchange, collection, or disposition of the property in the ordinary course of business;\n(3)\nIn the ordinary course of business, incur unsecured debt and pay expenses incidental to the receiver's preservation, use, sale, lease, license, exchange, collection, or disposition of receivership property;\n(4)\nAssert a right, claim, cause of action, or defense of the owner which relates to receivership property;\n(5)\nSeek and obtain instruction from the Superior Court concerning receivership property, exercise of the receiver's powers, and performance of the receiver's duties;\n(6)\nOn subpoena, compel a person to submit to examination under oath, or to produce and permit inspection and copying of designated records or tangible things, with respect to receivership property or any other matter that may affect administration of the receivership;\n(7)\nEngage a professional as provided in § 42-1654;\n(8)\nApply to a court of another state for appointment as ancillary receiver with respect to receivership property located in that state; and\n(9)\nExercise any power conferred by Superior Court order, this act, or law of the District other than this act.\n\n(b)\nWith the Superior Court's approval, a receiver may:\n(1)\nIncur debt for the use or benefit of receivership property other than in the ordinary course of business;\n(2)\nMake improvements to receivership property;\n(3)\nUse or transfer receivership property other than in the ordinary course of business as provided in § 42-1655;\n(4)\nAdopt or reject an executory contract of the owner as provided in § 42-1656;\n(5)\nPay compensation to the receiver as provided in § 42-1660, and to each professional engaged by the receiver as provided in § 42-1654;\n(6)\nRecommend allowance or disallowance of a claim of a creditor as provided in § 42-1659; and\n(7)\nMake a distribution of receivership property as provided in § 42-1659.\n\n(c)\nA receiver shall:\n(1)\nPrepare and retain appropriate business records, including a record of each receipt, disbursement, and disposition of receivership property;\n(2)\nAccount for receivership property, including the proceeds of a sale, lease, license, exchange, collection, or other disposition of the property;\n(3)\nFile with the Office of the Recorder of Deeds a copy of the order appointing the receiver and, if a legal description of the real property is not included in the order, the legal description;\n(4)\nDisclose to the Superior Court any fact arising during the receivership which would disqualify the receiver under § 42-1646; and\n(5)\nPerform any duty imposed by Superior Court order, this act, or law of the District other than this act.\n\n(d)\nThe powers and duties of a receiver may be expanded, modified, or limited by the Superior Court's order.","path":["Title 42.
