Code § 48-1002","heading":"Procedure for establishing a drug free zone.","body":"(a)\nThe Chief of Police may declare any public area a drug free zone for a period not to exceed 120 consecutive hours.\n\n(b)\nIn determining whether to designate a drug free zone, the Chief of Police shall consider the following\n(1)\nWithin the preceding 6-month period, the occurrence of a disproportionately high number of:\n(A)\nArrests for the possession or distribution of illegal drugs in the proposed drug free zone;\n(B)\nPolice reports for dangerous crimes, as that term is defined in § 23-1331(3), that were committed in the proposed drug free zone; or\n(C)\nPolice reports for crimes of violence, as that term is defined in § 23-1331(4), that were committed in the proposed drug free zone;\n(2)\nAny number of homicides that were committed in the proposed drug free zone;\n(3)\nObjective evidence or verifiable information that shows that illegal drugs are being sold and distributed on public space on public property within the proposed drug free zone; and\n(4)\nAny other verifiable information from which the Chief of Police may ascertain whether the health or safety of residents who live in the proposed drug free zone are endangered by the purchase, sale, or use of illegal drugs or other illegal activity.\n\n(c)\nAt least 24 hours prior to the designation of the drug free zone, the Chief of Police shall notify, in writing:\n(1)\nThe Chairman and each member of the Council of the District of Columbia of the declaration of the drug free zone and the boundaries of the drug free zone;\n(2)\nAll licensed medical or social services clinics operating in or adjacent to the drug free zone of the declaration of the drug free zone and the boundaries of the drug free zone; and\n(3)\nThe Deputy Mayor for Health and Human Services, the Director of the Department of Behavioral Health, the Director of the Department of Health, the Director of the Department of Human Services, the Deputy Mayor for Public Safety and Justice, the Director of the Office of Neighborhood Safety and Engagement, and the Office of the Attorney General's \"Cure the Streets\" program of the designation of the drug free zone, the boundaries of the drug free zone, and the need for any relevant medical or social services in the surrounding area, in order to ensure that this designation does not conflict with § 48-1004(c).\n\n(d)\nThe Chief of Police may not declare the same area, or an overlapping area, as a drug free zone for more than 360 consecutive hours or for more than 360 hours within a 30-day period.","path":["Title 48.
