Code § 50-921.30","heading":"Streatery program.","body":"\n      *NOTE: This section was created by temporary legislation that will expire on October 17, 2026.*\n      \n\n(a)\n(1)\nThe annual public space rental fee for a streatery permit shall be assessed at no more than $15 per square foot.\n(2)\nDistrict agencies shall begin enforcement activities relating to noncompliance with the Streatery Guidelines or applicable rules no sooner than January 15, 2026.\n\n(b)\n(1)\nIt is the policy of the District to promote streateries, as streateries are a beneficial use of public space that create a more vibrant dining scene and support local businesses.\n(2)\nIn furtherance of the policy described in paragraph (1) of this subsection, the Public Space Committee may waive the following program requirements; provided, that the waiver would not create an undue risk to pedestrians or other roadway users:\n(A)\nThe minimum required distance between streateries and curb cuts, driveways, alleys, and trees;\n(B)\nThe prohibition on streatery enclosures or vertical support structures that exceed 42 inches in height; and\n(C)\nThe maximum seating capacity of a streatery.\n(3)\nA streatery permit holder that receives an exception under paragraph (2) of this subsection shall apply for a streatery permit renewal through the Public Space Committee every 2 years.","path":["Title 50.
