Code § 8-102.05","heading":"Establishment of the Anacostia River Clean Up and Protection Fund.","body":"(a)\nThere is established as a special fund the Anacostia River Clean Up and Protection Fund (\"Fund\"), which shall be administered by the Director of the Department of Energy and Environment (\"DOEE\") in accordance with subsection (b) of this section.\n\n(a-1)\nThe following revenue shall be deposited in the Fund:\n(1)\nThe fees established by § 8-102.03 for disposable carryout bags that have been transmitted to the Office of Tax and Revenue;\n(2)\nThe net proceeds from the fees charged for the issuance and renewal of Anacostia River Commemorative License Plates pursuant to § 8-102.07;\n(3)\nFees collected for the application for and display of Protect Local Wildlife license plates pursuant to § 50-1501.02l(b)(1); and\n(4)\nThe net proceeds from the voluntary tax check-off provided for in § 47-1812.11d.\n\n(b)\nThe Fund shall be used solely for the purposes of cleaning and protecting the Anacostia River and other impaired waterways. Funds shall be used for the following projects:\n(1)\nA public education campaign to educate residents, businesses, and tourists about the impact of trash on the District’s environmental health;\n(1A)\nThe pilot program described in § 8-102.06a, and, at the discretion of the DOEE, the pilot program’s full implementation;\n(2)\nProviding reusable carryout bags to District residents, with priority distribution to seniors and low-income residents;\n(3)\nPurchasing and installing equipment, such as storm drain screens and trash traps, designed to minimize trash pollution that enters waterways through storm drains, with priority given to storm drains surrounding the significantly impaired tributaries identified by the DOEE;\n(4)\nCreating youth-oriented water resource and water pollution educational campaigns for students at the District public and charter schools;\n(5)\nMonitoring and recording pollution indices;\n(6)\nPreserving or enhancing water quality and fishery or wildlife habitat;\n(7)\nPromoting conservation programs, including programs for wildlife and endangered species;\n(7A)\nAwarding an annual grant, on a competitive basis, in an amount not to exceed $200,000, to provide wildlife rehabilitation services;\n(7B)\nIn Fiscal Year 2022, at least $50,000 to produce a report, which, upon its completion, shall be published on DOEE's website, analyzing the projected effects of banning the sale of beverages packaged in single-use plastic containers in the District, including effects on waterways, equity, and the local economy;\n(8)\nPurchasing and installing signs and equipment designed to minimize trash pollution, including anti-littering signs to be installed in areas where littering would impact the Anacostia River, recycling containers, and covered trash receptacles;\n(9)\nRestoring and enhancing wetlands and green infrastructure to protect the health of the watershed and restore the aquatic and land resources of its watershed;\n(10)\nFunding community cleanup events and other activities that reduce trash, such as increased litter collection;\n(11)\nFunding a circuit rider program with neighboring jurisdictions to focus river and tributary clean-up efforts upstream;\n(12)\nSupporting vocational and job training experiences in environmental and sustainable professions that enhance the health of the watershed;\n(13)\nMaintaining a public website that educates District residents on the progress of clean-up efforts; and\n(14)\nPaying for the administration of this program.\n\n(c)\n(1)\nThe Fund shall not be used to supplant funds appropriated as part of an approved annual budget for Anacostia River cleaning activities.\n(2)\nThe Fund shall not be used to fund street sweeping activities.\n\n(d)\n(1)\nThe money deposited into the Fund but not expended in a fiscal year shall not revert to the unassigned fund balance of the General Fund of the District of Columbia at the end of a fiscal year, or at any other time.\n(2)\nSubject to authorization in an approved budget and financial plan, any funds appropriated in the Fund shall be continually available without regard to fiscal year limitation.","path":["Title 8.
