To see the current law, click this link Current Version*\n      \n\n(a)\nThere is established a District Waterways Advisory Commission (\"Commission\") to advise the Office of District Waterways and to adopt a Waterways Advisory Plan pursuant to § 8-191.03.\n\n(b)\n(1)\nThe Commission shall be comprised of 14 voting members appointed as follows:\n(A)\nSeven members appointed by the Mayor, with the advice and consent of the Council, pursuant to § 1-523.01(e), one of whom shall be designated as Chairperson. Each appointee shall have experience in at least one of the following areas:\n(i)\nPublic safety;\n(ii)\nEnvironmental stewardship;\n(iii)\nEconomic development or tourism;\n(iv)\nMaritime management or policy;\n(v)\nAthletics and recreation; and\n(vi)\nMaritime transportation.\n(B)\nSeven members appointed by the Chairman of the Council as follows:\n(i)\nTwo Advisory Neighborhood Commissioners, each of whose single-member districts borders a waterway, one from east of the Anacostia River and one from west of the Anacostia River;\n(ii)\nTwo individuals, each representing a Business Improvement District that borders a waterway, one from east of the Anacostia River and one from west of the Anacostia River; and\n(iii)\nTwo individuals, each representing a marina or yacht club located in the District; provided, that the individuals do not represent the same marina or yacht club; and\n(iv)\nAn individual with expertise or interest in waterway management.\n(2)\nMembers appointed pursuant to this subsection shall serve for 4-year staggered terms; provided, that of the members initially appointed under this subsection, 4 of the members appointed by the Mayor shall be appointed for a term of 4 years and 3 for a term of one year, and of the members initially appointed by the Chairman of the Council, 4 shall serve for a term of 3 years and 3 shall serve for a term of 2 years.\n\n(c)\nThe government officials who head the following entities, or their designees, shall serve as ex officio non-voting members of the Commission:\n(1)\nThe Office of the Deputy Mayor for Planning and Economic Development;\n(2)\nThe Office of the Deputy Mayor for Public Safety and Justice;\n(3)\nThe Metropolitan Police Department;\n(4)\nThe Fire and Emergency Medical Services Department;\n(5)\nThe District Department of Transportation;\n(6)\nThe Department of Energy and Environment;\n(7)\nThe District of Columbia Water and Sewer Authority;\n(8)\nThe Washington Convention and Sports Authority;\n(9)\nThe Public Service Commission; and\n(10)\nThe Department of Housing and Community Development.\n\n(d)\nThe Mayor shall request that each of the following federal agencies appoint a representative as an ex officio non-voting member of the Commission:\n(1)\nThe National Park Service;\n(2)\nThe United States Coast Guard;\n(3)\nThe Department of Defense;\n(4)\nThe Metropolitan Washington Airports Authority; and\n(5)\nThe National Capital Planning Commission.\n\n(e)\nThe Office of Waterways Management shall provide administrative support to the Commission.\n\n(f)\nThe Commission shall meet at least once every month until the first Advisory Plan developed pursuant to § 8-191.03 is published and at least quarterly thereafter.\n\n(g)\nProceedings of the Commission are subject to subchapter IV of Chapter 5 of Title 2.\n\n(h)\nA majority of the members appointed pursuant to subsection (b) of this section shall constitute a quorum.","path":["Title 99.
