Stat. § 316.2071","heading":"Personal delivery devices and mobile carriers.","body":"(1) Notwithstanding any provision of law to the contrary, a personal delivery device or mobile carrier may operate on sidewalks and crosswalks, subject to s. 316.008(7)(b). A personal delivery device or mobile carrier operating on a sidewalk or crosswalk has all the rights and duties applicable to a pedestrian under the same circumstances, except that the personal delivery device or mobile carrier must not unreasonably interfere with pedestrians or traffic and must yield the right-of-way to pedestrians on the sidewalk or crosswalk.\n(2) A personal delivery device and a mobile carrier must:\n(a) Obey all official traffic and pedestrian control signals and devices.\n(b) For personal delivery devices, include a plate or marker that has a unique identifying device number and identifies the name and contact information of the personal delivery device operator.\n(c) Be equipped with a braking system that, when active or engaged, enables the personal delivery device or mobile carrier to come to a controlled stop.\n(3) A personal delivery device and a mobile carrier may not:\n(a) Operate on a public highway except to the extent necessary to cross a crosswalk.\n(b) Operate on a sidewalk or crosswalk unless the personal delivery device operator is actively controlling or monitoring the navigation and operation of the personal delivery device or a mobile carrier owner remains within 25 feet of the mobile carrier.\n(c) Transport hazardous materials as defined in s. 316.003.\n(d) For mobile carriers, transport persons or animals.\n(4) A person who owns and operates a personal delivery device in this state must maintain an insurance policy, on behalf of himself or herself and his or her agents, which provides general liability coverage of at least $100,000 for damages arising from the combined operations of personal delivery devices under the entity’s or agent’s control.\nHistory.—s. 3, ch. 2017-150; s. 3, ch. 2018-130.","path":["TITLE XXIII MOTOR VEHICLES","CHAPTER 316 STATE UNIFORM TRAFFIC CONTROL"],"source_url":"https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute\u0026URL=0300-0399/0316/0316.html","current_through":"2026 Florida Statutes","vintage":"","retrieved_at":"2026-08-27T02:03:01Z","sha256":"029300dcf2fda48a4eb2b9105241df387f5158e478cd6652cdd25042a3220ea0","source_id":"us-fl","stale":false,"prev":"us-fl/fla.-stat.-316.2069","next":"us-fl/fla.-stat.-316.2074"},"notice":"GroundRules: Original legal text.
