Stat. § 559.9615","heading":"Enforcement.","body":"(1) The Attorney General has exclusive authority to enforce this part. The Attorney General may:\n(a) Receive and act on complaints.\n(b) Take action designed to obtain voluntary compliance with this part.\n(c) Commence administrative or judicial proceedings to enforce compliance with this part.\n(2)(a) A violation of this part is punishable by a fine of $500 per incident, not to exceed $20,000 for all aggregated violations, arising from the use of the transaction documentation or materials found to be in violation of this part.\n(b) A violation of this part after receipt of a written notice of a prior violation from the Attorney General is punishable by a fine of $1,000 per incident, not to exceed $50,000 for all aggregated violations, arising from the use of the transaction documentation or materials found to be in violation of this part.\n(c) A violation of this part does not affect the enforceability or validity of the underlying commercial financing transaction.\n(3) This part does not create a private right of action against any person or entity based upon compliance or noncompliance with this part.\nHistory.—s. 1, ch. 2023-290.","path":["CHAPTER 559 REGULATION OF TRADE, COMMERCE, AND INVESTMENTS, GENERALLY"],"source_url":"https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute\u0026URL=0500-0599/0559/0559.html","current_through":"2026 Florida Statutes","vintage":"","retrieved_at":"2026-08-27T02:09:09Z","sha256":"de47094d79a3dc23a033a4bf7cd15aa8e1ff8de34e3fb29ff8f65993945fb8e8","source_id":"us-fl","stale":false,"prev":"us-fl/fla.-stat.-559.9614","next":"us-fl/fla.-stat.-560.103"},"notice":"GroundRules: Original legal text.
