Stat. § 627.64195","heading":"Requirements for opioid coverage.","body":"(1) DEFINITIONS.—As used in this section, the term:\n(a) “Abuse-deterrent opioid analgesic drug product” means a brand or generic opioid analgesic drug product approved by the United States Food and Drug Administration with an abuse-deterrence labeling claim that indicates the drug product is expected to deter abuse.\n(b) “Opioid analgesic drug product” means a drug product in the opioid analgesic drug class prescribed to treat moderate to severe pain or other conditions in immediate-release, extended-release, or long-acting form regardless of whether or not combined with other drug substances to form a single drug product or dosage form.\n(2) COVERAGE REQUIREMENTS.—A health insurance policy that provides coverage for abuse-deterrent opioid analgesic drug products:\n(a) May impose a prior authorization requirement for an abuse-deterrent opioid analgesic drug product only if the policy imposes the same prior authorization requirement for each opioid analgesic drug product without an abuse-deterrence labeling claim.\n(b) May not require use of an opioid analgesic drug product without an abuse-deterrence labeling claim before authorizing the use of an abuse-deterrent opioid analgesic drug product.\nHistory.—s. 1, ch. 2016-112.","path":["CHAPTER 627 INSURANCE RATES AND CONTRACTS"],"source_url":"https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute\u0026URL=0600-0699/0627/0627.html","current_through":"2026 Florida Statutes","vintage":"","retrieved_at":"2026-08-27T02:10:50Z","sha256":"377b0daf4247377dff931f1858eb5b7d4537ebb28b6ddf3a15c71c99c0d6f4dd","source_id":"us-fl","stale":false,"prev":"us-fl/fla.-stat.-627.64194","next":"us-fl/fla.-stat.-627.64196"},"notice":"GroundRules: Original legal text.
