Stat. § 720.404","heading":"Eligible communities; requirements for revival of declaration.","body":"Parcel owners in a community are eligible to seek approval from the Department of Commerce to revive a declaration of covenants under this act if all of the following requirements are met:\n(1) All parcels to be governed by the revived declaration must have been once governed by a previous declaration that has ceased to govern some or all of the parcels in the community;\n(2) The revived declaration must be approved in the manner provided in s. 720.405(6); and\n(3) The revived declaration may not contain covenants that are more restrictive on the parcel owners than the covenants contained in the previous declaration, except that the declaration may:\n(a) Have an effective term of longer duration than the term of the previous declaration;\n(b) Omit restrictions contained in the previous declaration;\n(c) Govern fewer than all of the parcels governed by the previous declaration;\n(d) Provide for amendments to the declaration and other governing documents; and\n(e) Contain provisions required by this chapter for new declarations that were not contained in the previous declaration.\nHistory.—s. 12, ch. 2004-345; s. 8, ch. 2004-353; s. 438, ch. 2011-142; s. 13, ch. 2018-55; s. 235, ch. 2024-6.","path":["CHAPTER 720 HOMEOWNERS’ ASSOCIATIONS"],"source_url":"https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute\u0026URL=0700-0799/0720/0720.html","current_through":"2026 Florida Statutes","vintage":"","retrieved_at":"2026-08-27T02:13:07Z","sha256":"894240e664768f6310399ce375c3f99fb2a4a0011e8c337ad0f6a9caa94020c0","source_id":"us-fl","stale":false,"prev":"us-fl/fla.-stat.-720.403","next":"us-fl/fla.-stat.-720.405"},"notice":"GroundRules: Original legal text.
