Stat. § 736.0111","heading":"Nonjudicial settlement agreements.","body":"(1) For purposes of this section, the term “interested persons” means persons whose interest would be affected by a settlement agreement.\n(2) Except as otherwise provided in subsection (3), interested persons may enter into a binding nonjudicial settlement agreement with respect to any matter involving a trust.\n(3) A nonjudicial settlement agreement among the trustee and trust beneficiaries is valid only to the extent the terms and conditions could be properly approved by the court. A nonjudicial settlement may not be used to produce a result not authorized by other provisions of this code, including, but not limited to, terminating or modifying a trust in an impermissible manner.\n(4) Matters that may be resolved by a nonjudicial settlement agreement include:\n(a) The interpretation or construction of the terms of the trust.\n(b) The approval of a trustee’s report or accounting.\n(c) The direction to a trustee to refrain from performing a particular act or the grant to a trustee of any necessary or desirable power.\n(d) The resignation or appointment of a trustee and the determination of a trustee’s compensation.\n(e) The transfer of a trust’s principal place of administration.\n(f) The liability of a trustee for an action relating to the trust.\n(5) Any interested person may request the court to approve or disapprove a nonjudicial settlement agreement.\nHistory.—s. 1, ch. 2006-217.","path":["CHAPTER 736 FLORIDA TRUST CODE"],"source_url":"https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute\u0026URL=0700-0799/0736/0736.html","current_through":"2026 Florida Statutes","vintage":"","retrieved_at":"2026-08-27T02:13:29Z","sha256":"c03455d5d04fcdb41e526314f7e5e3e455557d6f79092af36af8595613865ef8","source_id":"us-fl","stale":false,"prev":"us-fl/fla.-stat.-736.0110","next":"us-fl/fla.-stat.-736.0112"},"notice":"GroundRules: Original legal text.
