Stat. § 784.0493","heading":"Harassment or intimidation based on religious or ethnic heritage.","body":"(1) As used in this section, the terms “credible threat” and “harass” have the same meaning as in s. 784.048(1).\n(2) A person may not willfully and maliciously harass or intimidate another person based on the person’s wearing or displaying of any indicia relating to any religious or ethnic heritage.\n(3) A person who violates subsection (2) commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.\n(4) A person who violates subsection (2), and in the course of committing the violation makes a credible threat to the person who is the subject of the harassment or intimidation, commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.\n(5) A violation of this section is considered a hate crime for purposes of the reporting requirements of s. 877.19.\nHistory.—s. 2, ch. 2023-24.","path":["CHAPTER 784 ASSAULT; BATTERY; CULPABLE NEGLIGENCE"],"source_url":"https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute\u0026URL=0700-0799/0784/0784.html","current_through":"2026 Florida Statutes","vintage":"","retrieved_at":"2026-08-27T02:14:25Z","sha256":"115055ca750760c6ed671650ef64e3fe55b7716d10cd83ce47e932791daf2603","source_id":"us-fl","stale":false,"prev":"us-fl/fla.-stat.-784.049","next":"us-fl/fla.-stat.-784.0495"},"notice":"GroundRules: Original legal text.
