Stat. § 88.7041","heading":"Initiation by Department of Revenue of support proceeding under convention.","body":"(1) In a support proceeding under this part, the Department of Revenue shall:\n(a) Transmit and receive applications; and\n(b) Initiate or facilitate the institution of a proceeding regarding an application in a tribunal of this state.\n(2) The following support proceedings are available to an obligee under the convention:\n(a) Recognition or recognition and enforcement of a foreign support order.\n(b) Enforcement of a support order issued or recognized in this state.\n(c) Establishment of a support order if there is no existing order, including, where necessary, determination of parentage of a child.\n(d) Establishment of a support order if recognition of a foreign support order is refused under s. 88.7081(2)(b), (d), or (i).\n(e) Modification of a support order of a tribunal of this state.\n(f) Modification of a support order of a tribunal of another state or a foreign country.\n(3) The following support proceedings are available under the convention to an obligor against whom there is an existing support order:\n(a) Recognition of an order suspending or limiting enforcement of an existing support order of a tribunal of this state.\n(b) Modification of a support order of a tribunal of this state.\n(c) Modification of a support order of a tribunal of another state or foreign country.\n(4) A tribunal of this state may not require security, bond, or deposit, however described, to guarantee the payment of costs and expenses in proceedings under the convention.\nHistory.—s. 62, ch. 2011-92.","path":["CHAPTER 88 UNIFORM INTERSTATE FAMILY SUPPORT ACT"],"source_url":"https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute\u0026URL=0000-0099/0088/0088.html","current_through":"2026 Florida Statutes","vintage":"","retrieved_at":"2026-08-27T01:58:43Z","sha256":"0f60960042816fe9e3a6e3aaa0dd911f0af7c7b6eeb4f26aa76c409c9de6c30c","source_id":"us-fl","stale":false,"prev":"us-fl/fla.-stat.-88.7031","next":"us-fl/fla.-stat.-88.7051"},"notice":"GroundRules: Original legal text.
