{"data":{"id":"us-ga/o.c.g.a.-10-1-359.3","jurisdiction":"us-ga","citation":"O.C.G.A. § 10-1-359.3","heading":"Forfeiture; items declared contraband.","body":"(a) As used in this Code section, the term:\n(1) “Crime” means:\n(A) Theft by taking in violation of Code Section 16-8-2, theft by conversion in violation of Code Section 16-8-4, or theft by receiving stolen property in violation of Code Section 16-8-7 if the subject of the theft was regulated metal property;\n(B) Criminal damage to property in the first degree in violation of paragraph (2) of subsection (a) of Code Section 16-7-22; or\n(C) A criminal violation of this article.\n(2) “Proceeds” shall have the same meaning as set forth in Code Section 16-13-49.\n(3) “Property” shall have the same meaning as set forth in Code Section 16-13-49.\n(b) The following are declared to be contraband, and no person shall have a property right in them:\n(1) Any property which is, directly or indirectly, used or intended for use in any manner to facilitate a crime and any proceeds derived or realized therefrom; and\n(2) Any weapon possessed, used, or available for use in any manner to facilitate a crime.\n(c) Any property subject to forfeiture pursuant to subsection (b) of this Code section shall be forfeited in accordance with the procedures set forth in Code Section 16-13-49.","path":["TITLE 10 Commerce and Trade","CHAPTER 1 Selling and Other Trade Practices","Article 14 Secondary Metals Recyclers"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.10.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"782a9b0177e6d8ceb60daeede88e449f9e1e11c1584b9880d5c24e79da0c9d58","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-10-1-359.2","next":"us-ga/o.c.g.a.-10-1-359.4"},"notice":"GroundRules: Original legal text.
