{"data":{"id":"us-ga/o.c.g.a.-16-10-94.1","jurisdiction":"us-ga","citation":"O.C.G.A. § 16-10-94.1","heading":"Willful destruction, alteration, or falsification of medical records.","body":"(a) As used in this Code section, the term:\n(1) “Patient” means any person who has received health care services from a provider.\n(2) “Provider” means all hospitals, including public, private, osteopathic, and tuberculosis hospitals; other special care units, including podiatric facilities, skilled nursing facilities, and kidney disease treatment centers, including freestanding hemodialysis units; intermediate care facilities; ambulatory surgical or obstetrical facilities; health maintenance organizations; and home health agencies. Such term shall also mean any person licensed to practice under Chapter 9, 11, 26, 34, 35, or 39 of Title 43.\n(3) “Record” means a patient’s health record, including, but not limited to, evaluations, diagnoses, prognoses, laboratory reports, X-rays, prescriptions, and other technical information used in assessing the patient’s condition, or the pertinent portion of the record relating to a specific condition or a summary of the record.\n(b) Any person who, with intent to conceal any material fact relating to a potential claim or cause of action, knowingly and willfully destroys, alters, or falsifies any record shall be guilty of a misdemeanor.","path":["TITLE 16 Crimes and Offenses","CHAPTER 10 Offenses Against Public Administration","Article 5 Offenses Related to Judicial and Other Proceedings"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.16.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"665f78520625f6bdf85417d9525b3d88f49400395cf58c206504c9135124df02","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-16-10-94","next":"us-ga/o.c.g.a.-16-10-95"},"notice":"GroundRules: Original legal text.
