{"data":{"id":"us-ga/o.c.g.a.-16-3-6","jurisdiction":"us-ga","citation":"O.C.G.A. § 16-3-6","heading":"Affirmative defenses to certain sexual crimes.","body":"(a) As used in this Code section, the term:\n(1) “Coercion” shall have the same meaning as set forth in Code Section 16-5-46.\n(2) “Deception” shall have the same meaning as set forth in Code Section 16-5-46.\n(3) “Sexual crime” means prostitution, sodomy, solicitation of sodomy, or masturbation for hire as such offenses are proscribed in Chapter 6 of Title 16.\n(4) “Sexual servitude” shall have the same meaning as set forth in Code Section 16-5-46.\n(b) A person shall not be guilty of a sexual crime if the conduct upon which the alleged criminal liability is based was committed by an accused who was:\n(1) Less than 18 years of age at the time of the conduct such person was being trafficked for sexual servitude in violation of subsection (c) of Code Section 16-5-46; or\n(2) Acting under coercion or deception while the accused was being trafficked for sexual servitude in violation of subsection (c) of Code Section 16-5-46.\n(c) A defense based upon any of the provisions of this Code section shall be an affirmative defense.","path":["TITLE 16 Crimes and Offenses","CHAPTER 3 Defenses to Criminal Prosecutions","Article 1 Responsibility"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.16.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"20dac3a6a2dd22a2e557ce06a0cece0138c3b375c1459774a464a5dc99f151d7","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-16-3-5","next":"us-ga/o.c.g.a.-16-3-20"},"notice":"GroundRules: Original legal text.
