{"data":{"id":"us-ga/o.c.g.a.-16-7-2","jurisdiction":"us-ga","citation":"O.C.G.A. § 16-7-2","heading":"Smash and grab burglary; “retail establishment” defined; penalty.","body":"(a) As used in this Code section, the term “retail establishment” means an establishment that sells goods or merchandise from a fixed location for direct consumption by a purchaser and includes establishments that prepare and sell meals or other edible products either for carry out or service within the establishment.\n(b) A person commits the offense of smash and grab burglary when he or she intentionally and without authority enters a retail establishment with the intent to commit a theft and causes damage in excess of $500.00 to such establishment without the owner’s consent.\n(c) A person convicted of smash and grab burglary shall be guilty of a felony and, upon conviction, shall be punished by imprisonment for not less than two nor more than 20 years, by a fine of not more than $100,000.00, or both; provided, however, that upon a second or subsequent conviction, he or she shall be punished by imprisonment for not less than five nor more than 20 years, by a fine of not more than $100,000.00, or both.","path":["TITLE 16 Crimes and Offenses","CHAPTER 7 Damage to and Intrusion upon Property","Article 1 Burglary"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.16.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"424f2e29e17e4cb61dce33544cf0bb519ac68df0fb91752f4899dc6f9c9d8dbe","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-16-7-1","next":"us-ga/o.c.g.a.-16-7-5"},"notice":"GroundRules: Original legal text.
