{"data":{"id":"us-ga/o.c.g.a.-17-14-10","jurisdiction":"us-ga","citation":"O.C.G.A. § 17-14-10","heading":"Factors to be considered by ordering authority in determining nature and amount of restitution.","body":"(a) In determining the nature and amount of restitution, the ordering authority shall consider:\n(1) The financial resources and other assets of the offender or person ordered to pay restitution including whether any of the assets are jointly controlled;\n(2) The earnings and other income of the offender or person ordered to pay restitution;\n(3) Any financial obligations of the offender or person ordered to pay restitution, including obligations to dependents;\n(4) The amount of damages;\n(5) The goal of restitution to the victim and the goal of rehabilitation of the offender;\n(6) Any restitution previously made;\n(7) The period of time during which the restitution order will be in effect; and\n(8) Other factors which the ordering authority deems to be appropriate.\n(b) If, subsequent to restitution being ordered pursuant to this article, a victim is convicted of a crime for which restitution is ordered, the ordering authority shall consider the previously ordered restitution as part of the financial resources of such victim.","path":["TITLE 17 Criminal Procedure","CHAPTER 14 Restitution and Distribution of Profits to Victims of Crimes","Article 1 Restitution"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.17.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"e23c254158d363b4bfb1027e562618a9881f28de288ca5e21381fd1d642222b0","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-17-14-9","next":"us-ga/o.c.g.a.-17-14-11"},"notice":"GroundRules: Original legal text.
