{"data":{"id":"us-ga/o.c.g.a.-20-2-774","jurisdiction":"us-ga","citation":"O.C.G.A. § 20-2-774","heading":"Self-administration of asthma medication.","body":"(a) As used in this Code section, the term:\n(1) “Medication” means a medicine prescribed by:\n(A) A physician licensed under Chapter 34 of Title 43; or\n(B) A physician assistant licensed under Chapter 34 of Title 43 who is authorized to prescribe medicine for the treatment of asthma in accordance with said chapter.\n(2) “Self-administration of asthma medication” means a student’s discretionary use of asthma medication prescribed for him or her.\n(b) Each local board of education shall adopt a policy authorizing the self-administration of asthma medication by a student who has asthma, provided that any student who is authorized for self-administration of asthma medication under such policy may possess and use his or her asthma medication:\n(1) While in school;\n(2) At a school sponsored activity;\n(3) While under the supervision of school personnel; or\n(4) While in before-school or after-school care on school operated property.\n(c) Each public school in this state shall permit the self-administration of asthma medication by a student who has asthma, subject to the local policy adopted pursuant to subsection (b) of this Code section; and the school district and its employees and agents shall incur no liability other than for willful or wanton misconduct for any injury to a student caused by his or her self-administration of asthma medication.","path":["TITLE 20 Education","CHAPTER 2 Elementary and Secondary Education","Article 16 Students","PART 3 Health"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.20.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"7a42c6a831d7523f5877af62035e17cd536f4ac4aa4de06811d5d83396e980f6","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-20-2-773","next":"us-ga/o.c.g.a.-20-2-775"},"notice":"GroundRules: Original legal text.
