{"data":{"id":"us-ga/o.c.g.a.-31-52-3","jurisdiction":"us-ga","citation":"O.C.G.A. § 31-52-3","heading":"Definitions.","body":"As used in this chapter, the term:\n(1) “Eligible patient” means a person who meets the requirements of Code Section 31-52-4.\n(2) “Investigational drug, biological product, or device” means a drug, biological product, or device which has successfully completed Phase I of a federal Food and Drug Administration approved clinical trial but has not yet been approved for general use by the federal Food and Drug Administration and currently remains under investigation in a federal Food and Drug Administration approved clinical trial.\n(3) “Physician” means a person licensed to practice medicine pursuant to Article 2 of Chapter 34 of Title 43.\n(4) “Terminal illness” means a disease that, without life-sustaining procedures, will result in death in the near future and is not considered by a treating physician to be reversible even with administration of current federal Food and Drug Administration approved and available treatments.\n(5) “Written informed consent” means a written document that:\n(A) Is signed by the patient; parent, if the patient is a minor; legal guardian; or health care agent designated by the patient in an advance directive for health care executed pursuant to Chapter 32 of Title 31;\n(B) Is attested to by the patient’s physician and a witness; and\n(C) Meets the requirements of Code Section 31-52-5.","path":["TITLE 31 Health","CHAPTER 52 Terminally Ill Patient’s Right To Try Investigational Drugs, Biological Products, and Devices"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.31.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"37bf486b1b13621240c9dbcf833520b57b907740a58397a596414878eb8c653c","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-31-52-2","next":"us-ga/o.c.g.a.-31-52-4"},"notice":"GroundRules: Original legal text.
