{"data":{"id":"us-ga/o.c.g.a.-37-11-11","jurisdiction":"us-ga","citation":"O.C.G.A. § 37-11-11","heading":"Inclusion in medical record; continuing consent.","body":"(a) Upon being presented with a psychiatric advance directive, a provider or facility shall make the directive a part of a declarant’s medical record.\n(b) In the absence of specific knowledge of the revocation or invalidity of a directive, a provider or facility providing mental health care to a declarant may presume that a person who executed a psychiatric advance directive in accordance with this chapter was of sound mind and acted voluntarily when executing such directive and may rely upon a psychiatric advance directive or a copy of that directive.\n(c) A provider or facility shall be authorized to act in accordance with a directive when a declarant is incapable of making mental health care decisions.\n(d) A provider or facility shall continue to obtain a declarant’s consent to all mental health care decisions if he or she is capable of providing consent or refusal.","path":["TITLE 37 Mental Health","CHAPTER 11 Psychiatric Advance Directive"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.37.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"ba72c0268035aa471092c484b1b7a039688e88f22566e07e2bfec6d49073836c","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-37-11-10","next":"us-ga/o.c.g.a.-37-11-12"},"notice":"GroundRules: Original legal text.
