{"data":{"id":"us-ga/o.c.g.a.-42-1-1","jurisdiction":"us-ga","citation":"O.C.G.A. § 42-1-1","heading":"Definitions.","body":"Except as specifically provided otherwise, as used in this title, the term:\n(1) “Board” means the Board of Corrections.\n(2) “Case plan” means an individualized accountability and behavior change strategy for a probationer, as applicable.\n(3) “Commissioner” means the commissioner of corrections.\n(4) “Criminal risk factors” means characteristics and behaviors that affect a person’s risk for committing future crimes and include, but are not limited to, antisocial behavior, antisocial personality, criminal thinking, criminal associates, having a dysfunctional family, having low levels of employment or education, poor use of leisure and recreation time, and substance abuse.\n(5) “Department” means the Department of Corrections.\n(6) “Graduated sanctions” means:\n(A) Verbal and written warnings;\n(B) Increased restrictions and reporting requirements;\n(C) Community service or work crews;\n(D) Referral to substance abuse or mental health treatment or counseling programs in the community;\n(E) Increased substance abuse screening and monitoring;\n(F) Electronic monitoring, as such term is defined in Code Section 42-3-111; and\n(G) An intensive supervision program.\n(7) “Risk and needs assessment” means an actuarial tool, approved by the board and validated on a targeted population, scientifically proven to determine a person’s risk to recidivate and to identify criminal risk factors that, when properly addressed, can reduce that person’s likelihood of committing future criminal behavior.","path":["TITLE 42 Penal Institutions","CHAPTER 1 General Provisions","Article 1 Inmate Policies"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.42.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"473632ce9a9a42715b741a4fefd3f50e99a21dc5392b0b9cf4825bfe18f8b609","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-41-3-13","next":"us-ga/o.c.g.a.-42-1-2"},"notice":"GroundRules: Original legal text.
