{"data":{"id":"us-ga/o.c.g.a.-42-12-7","jurisdiction":"us-ga","citation":"O.C.G.A. § 42-12-7","heading":"Deductions from prisoner’s accounts; payment of costs and fees as condition of parole.","body":"(a) Fifty percent of the average monthly balance of the prisoner’s account for the preceding 12 months during which the prisoner’s account had a positive balance shall be deducted from the prisoner’s account and paid over to the clerk of court for each instance that a court finds that the prisoner has done any of the following:\n(1) Filed a false, frivolous, or malicious action or claim with the court;\n(2) Brought an action or claim with the court solely or primarily for delay or harassment;\n(3) Unreasonably expanded or delayed a judicial proceeding;\n(4) Testified falsely or otherwise submitted false evidence or information to the court;\n(5) Attempted to create or obtain a false affidavit, testimony, or evidence; or\n(6) Abused the discovery process in any judicial action or proceeding.\n(b) Payment of any past due court costs and fees incurred by the prisoner may be, pursuant to this subsection, a condition of parole, at the discretion of the State Board of Pardons and Paroles.","path":["TITLE 42 Penal Institutions","CHAPTER 12 Prison Litigation Reform"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.42.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"2b2162d46525e65dcfe17aa153ccbd264fae349786c0385a8f9488caf5f2dfa9","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-42-12-6","next":"us-ga/o.c.g.a.-42-12-7.1"},"notice":"GroundRules: Original legal text.
