{"data":{"id":"us-ga/o.c.g.a.-44-10-2","jurisdiction":"us-ga","citation":"O.C.G.A. § 44-10-2","heading":"Definitions.","body":"As used in this article, the term:\n(1) “Conservation easement” means a nonpossessory interest of a holder in real property imposing limitations or affirmative obligations, the purposes of which include retaining or protecting natural, scenic, or open-space values of real property; assuring its availability for agricultural, forest, recreational, or open-space use; protecting natural resources; maintaining or enhancing air or water quality; or preserving the historical, architectural, archeological, or cultural aspects of real property.\n(2) “Holder” means:\n(A) A governmental body empowered to hold an interest in real property under the laws of this state or the United States; or\n(B) A charitable corporation, charitable association, or charitable trust, the purposes or powers of which include retaining or protecting the natural, scenic, or open-space values of real property; assuring the availability of real property for agricultural, forest, recreational, or open-space use; protecting natural resources; maintaining or enhancing air or water quality; or preserving the historical, architectural, archeological, or cultural aspects of real property.\n(3) “Third-party right of enforcement” means a right provided in a conservation easement to enforce any of its terms granted to a governmental body, charitable corporation, charitable association, or charitable trust, which, although eligible to be a holder, is not a holder.","path":["TITLE 44 Property","CHAPTER 10 Historic Preservation","Article 1 Uniform Conservation Easements"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.44.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"08f458655e8753d7ef1265ae0d2acc2b5b3eadc3252d605d1cad84aef97f100d","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-44-10-1","next":"us-ga/o.c.g.a.-44-10-3"},"notice":"GroundRules: Original legal text.
