{"data":{"id":"us-ga/o.c.g.a.-44-6-202","jurisdiction":"us-ga","citation":"O.C.G.A. § 44-6-202","heading":"Time of creation of nonvested property interest or power of appointment.","body":"(a) Except as provided in subsections (b) and (c) of this Code section and in subsection (a) of Code Section 44-6-205, the time of creation of a nonvested property interest or a power of appointment is determined under general principles of property law.\n(b) For purposes of this article, if there is a person who alone can exercise a power created by a governing instrument to become the unqualified beneficial owner of:\n(1) A nonvested property interest; or\n(2) A property interest subject to a power of appointment described in subsection (b) or (c) of Code Section 44-6-201,\nthe nonvested property interest or power of appointment is created when the power to become the unqualified beneficial owner terminates.\n(c) For purposes of this article, a nonvested property interest or a power of appointment arising from a transfer of property to a previously funded trust or other existing property arrangement is created when the nonvested property interest or power of appointment in the original contribution was created.","path":["TITLE 44 Property","CHAPTER 6 Estates","Article 9 Uniform Statutory Rule Against Perpetuities"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.44.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"97bd93a24eb7fae02f57504771b982aac26b07fabe6a30fa118a09548c7a1a89","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-44-6-201","next":"us-ga/o.c.g.a.-44-6-203"},"notice":"GroundRules: Original legal text.
