{"data":{"id":"us-ga/o.c.g.a.-53-13-14","jurisdiction":"us-ga","citation":"O.C.G.A. § 53-13-14","heading":"Custodian’s disclosure of catalogue of electronic communications; circumstances.","body":"Unless the user prohibited disclosure of digital assets or the court directs otherwise, a custodian shall disclose to the personal representative of the estate of a deceased user a catalogue of electronic communications sent or received by the user and digital assets, other than the content of electronic communications, of the user, if the personal representative gives the custodian:\n(1) A written request for disclosure in physical or electronic form;\n(2) A certified copy of the death certificate of the user;\n(3) A certified copy of the letters testamentary, letters of administration, or other letters of appointment of the personal representative; and\n(4) If requested by the custodian:\n(A) A number, username, address, or other unique subscriber or account identifier assigned by the custodian to identify the user’s account;\n(B) Evidence linking the account to the user;\n(C) An affidavit stating that disclosure of the user’s digital assets is reasonably necessary for administration of the estate; or\n(D) A finding by the court that:\n(i) The user had a specific account with the custodian, identifiable by the information specified in subparagraph (A) of this paragraph; or\n(ii) Disclosure of the user’s digital assets is reasonably necessary for administration of the estate.","path":["TITLE 53 Wills, Trusts, and Administration of Estates","CHAPTER 13 Revised Uniform Fiduciary Access to Digital Assets","Article 2 Rights of Custodians or Users"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.53.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:58Z","sha256":"d08d1624f7fd4bcee47161b296cbf760d38c25dc6c300441d90f2d1c84e1f88e","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-53-13-13","next":"us-ga/o.c.g.a.-53-13-15"},"notice":"GroundRules: Original legal text.
