{"data":{"id":"us-ga/o.c.g.a.-6-2-5.1","jurisdiction":"us-ga","citation":"O.C.G.A. § 6-2-5.1","heading":"Operation or physical control of aircraft while under the influence of alcohol or drugs; penalty.","body":"(a) A person shall not operate or be in actual physical control of an aircraft in this state:\n(1) Within eight hours after the consumption of any alcoholic beverage;\n(2) While under the influence of alcohol;\n(3) While using any drug that affects such person’s faculties in any way contrary to safety; or\n(4) While there is 0.04 percent or more by weight of alcohol in his blood.\n(b) Any person arrested for violation of this Code section shall, at the request of a law enforcement officer of the state or any political subdivision, be administered a test as provided by and subject to the restrictions of subsection (a) of Code Section 40-6-392.\n(c) A person who violates this Code section shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not to exceed $2,000.00.","path":["TITLE 6 Aviation","CHAPTER 2 Regulation of Aeronautics, Aircraft, and Airports Generally"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.06.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"d180abe426d209d97eae7f851145cd58a6459f59add258e4f8913da2e30f835a","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-6-2-5","next":"us-ga/o.c.g.a.-6-2-5.2"},"notice":"GroundRules: Original legal text.
