{"data":{"id":"us-ga/o.c.g.a.-9-17-8","jurisdiction":"us-ga","citation":"O.C.G.A. § 9-17-8","heading":"Review of mediator’s conflict of interest; required disclosures by mediator; exclusion; special qualifications not required.","body":"(a) Before accepting a mediation, an individual who is requested to serve as a mediator shall:\n(1) Make an inquiry that is reasonable under the circumstances to determine whether there are any known facts that a reasonable individual would consider likely to affect the impartiality of the mediator, including a financial or personal interest in the outcome of the mediation and an existing or past relationship with a mediation party or foreseeable participant in the mediation; and\n(2) Disclose any such known fact to the mediation parties as soon as is practical before accepting a mediation.\n(b) If a mediator learns any fact described in paragraph (1) of subsection (a) of this Code section after accepting a mediation, the mediator shall disclose it as soon as is practicable.\n(c) At the request of a mediation party, an individual who is requested to serve as a mediator shall disclose the mediator’s qualifications to mediate a dispute.\n(d) A person that violates subsection (a) or (b) of this Code section is precluded by the violation from asserting a privilege under Code Section 9-17-3.\n(e) Subsection (a), (b), or (c) of this Code section shall not apply to an individual acting as a judge.\n(f) This chapter shall not require that a mediator have a special qualification by background or profession.","path":["TITLE 9 Civil Practice","CHAPTER 17 Georgia Uniform Mediation Act"],"source_url":"https://archive.org/download/gov.ga.ocga.2018/release86.2022.11/gov.ga.ocga.title.09.odt","current_through":"Release 86 (2022-11)","vintage":"Public.Resource.Org bulk O.C.G.A., Release 86 (2022-11), retrieved 2026-09-17","retrieved_at":"2026-09-17T19:34:57Z","sha256":"eb2746279f55c26d21f9a32a3fcde6798a08188bb5b3f55007cf1a8202b0c6e1","source_id":"us-ga","stale":false,"prev":"us-ga/o.c.g.a.-9-17-7","next":"us-ga/o.c.g.a.-9-17-9"},"notice":"GroundRules: Original legal text.
