{"data":{"id":"us-gu/10-gca-2913","jurisdiction":"us-gu","citation":"10 GCA § 2913","heading":"Exclusions.","body":"The Medically Indigent Program does not cover the following services:\n(a) voluntary abortions, abortions and interrupted pregnancy that are not medically necessary;\n(b) elective cosmetic surgery, except as provided for in the Women’s Health Act;\n(c) custodial care, domiciliary care, private duty nursing services or rest cures, except as provided for in hospices;\n(d) personal comfort or convenience items;\n(e) any service not medically necessary for the diagnosis or treatment of a disease, injury or condition;\n(f) non-emergency use of Emergency Room;\n(g) over-the-counter drugs not listed in the Drug Formulary;\n(h) drugs not listed in the Drug Formulary, unless otherwise provided in this Act;\n(i) experimental drugs, experimental and palliative treatments or procedures, unless approved by the Administrator;\n(j) fertility procedures, reversal of sterilization and services related to artificial conception;\n(k) treatment, services and supplies related to sexual dysfunction;\n(l) trans-sexual surgery and related services;\n(m) motorized limbs;\n(n) services for any incarcerated person;\n(o) care or services furnished by immediate relatives or members of the patient’s household, unless rendered as a duly licensed medical practitioner employed by a health care Provider;\n(p) health care services, which are provided and reimbursed by other local or Federal programs, MIP is the payer of last resort;\n(q) speech and language therapy;\n(r) tissue and organ transplants, and any other related hospital, surgical drug, radiology, laboratory or other medical services before, during and after transplant;\n(s) treatment and services for artificial weight reduction, including gastric bypass stapling or reversal, or liposuction;\n(t) treatment by any method for temporomandibular joint disorders, including, but not limited to, crowning, wiring or repositioning of teeth;\n(u) treatment for injuries sustained in the commission of an illegal or criminal act, including driving under the influence;\n(v) any work-related injury, subject to compensation pursuant to the Workers Compensation Law;\n(w) care for military service connected disabilities to which the patient is legally entitled to government benefits or care;\n(x) orthopedic footwear, unless attached to an artificial foot or unless attached as a permanent part of a leg brace; and\n(y) benefits and services not specifically listed as covered.","path":["Title 10: Health and Safety","Division 1 - Public Health","Chapter 2: Division of Public Welfare","ARTICLE 9: MEDICALLY INDIGENT PROGRAM"],"source_url":"https://col.guamcourts.gov/sites/default/files/10gc002.pdf","current_through":"P.L. 38-133 (June 4, 2026)","vintage":"","retrieved_at":"2026-09-27T02:52:58Z","sha256":"f683bd002b8ebf98fe191cf6b7fac7d08dcdd3ffd3cc1a7497184e67f040620d","source_id":"us-gu","stale":false,"prev":"us-gu/10-gca-2912.10","next":"us-gu/10-gca-2914"},"notice":"GroundRules: Original legal text.
