{"data":{"id":"us-gu/10-gca-4103","jurisdiction":"us-gu","citation":"10 GCA § 4103","heading":"Definitions.","body":"(a) \u003eInfant= means a child who is not a newborn and has not attained the age of one (1) year.\n(b) \u003eNewborn= means a child up to twenty-eight (28) days old.\n(c) \u003eChild= means a person up to twenty-one (21) years of age.\n(d) \u003eParent= means a natural parent, stepparent, adoptive parents, guardian, or custodian of a newborn or infant.\n(e) \u003eBirth Admission= means the time after birth that the newborn remains in the hospital nursery prior to discharge.\n(f) \u003eICC Subcommittee= means the subcommittee of the Guam Interagency Coordinating Council of the Guam Early Intervention System tasked with monitoring newborn hearing screening, tracking, and intervention.\n(g) \u003eFalse Positive Rate= means the proportion of infants identified as having a significant hearing loss by the screening process who are ultimately found to not have a significant hearing loss.\n(h) \u003eFalse Negative Rate= means the proportion of infants not identified as having a significant hearing loss by the screening process who are ultimately found to have a significant hearing loss.\n(i) \u003eHealth Care Insurer= means any entity regulated by the Commissioner of Banking and Insurance, including, but not limited to, health care insurers; health, hospital or medical service plan corporations; or health maintenance organizations. Health care insurer does not include self-insured plans or groups regulated by the Employment Retirement Income Security Act of 1974 (\u003eERISA=), to the extent that Guam regulation of such plans is preempted by ERISA.\n(j) \u003eHealth Insurance Policy= means any health insurance policy, contract, plan, or evidence of coverage issued by a health care insurer, which provides medical coverage on an expense incurred, service or prepaid basis.\n(k) \u003eHearing Screening Test= means automated auditory brainstem response, otoacoustic emissions, or any other appropriate screening test as recommended by national professional medical and health organizations and approved by the DPH\u0026SS.\n(l) \u003eHealth Care Facility= means any institution, building or agency whether public or private (for-profit or non-profit) that is used or designed to provide health care services, medical treatment or preventive care to any person or persons.\n(m) \u003eHearing Loss== means a hearing loss of twenty-five (25) dB HL or greater in the frequency region important for speech recognition and comprehension in one or both ears (approximately 500 through 4000 Hz).","path":["Title 10: Health and Safety","Division 1 - Public Health","Chapter 4: Universal Newborn Hearing Screening and Intervention Act (UNHSIA) of 2004"],"source_url":"https://col.guamcourts.gov/sites/default/files/10gc004.pdf","current_through":"P.L. 38-133 (June 4, 2026)","vintage":"","retrieved_at":"2026-09-27T02:53:18Z","sha256":"146017aa55ac8bd2675a9d5555545e5eed88db8dfbffa8ef76724329f442e27c","source_id":"us-gu","stale":false,"prev":"us-gu/10-gca-4102","next":"us-gu/10-gca-4104"},"notice":"GroundRules: Original legal text.
