{"data":{"id":"us-gu/10-gca-95102","jurisdiction":"us-gu","citation":"10 GCA § 95102","heading":"Employer Obligations.","body":"Where a parent is required by a court or administrative order to provide health coverage, which is available through an employer doing business in Guam, the employer is required:\n(a) To permit the parent to enroll under family coverage any child who is otherwise eligible for coverage without regard to any enrollment season or open enrollment restrictions;\n(b) If the parent is enrolled but fails to make application to obtain coverage of the child, to enroll the child under family coverage upon application by the child=s other parent, by the Guam agency administering the Medicaid program or the Guam agency administering §§651 to 669, Title 42 United States Code, the child support enforcement program;\n(c) Not to disenroll (or eliminate coverage of) the child unless the insurer is provided satisfactory written evidence that:\n(i) The court order is no longer in effect;\n(ii) The child is or will be enrolled in comparable coverage which will take effect no later than the effective date of disenrollment; or\n(iii) The employer has eliminated family health coverage for all of its employees.\n(d) To withhold from the employee=s compensation the employee=s share (if any) of premiums for health coverage and to pay this amount to the insurer.","path":["Title 10: Health and Safety","Division 4 - Guam Health Act","Chapter 95: Coordination of Benefits"],"source_url":"https://col.guamcourts.gov/sites/default/files/10gc095.pdf","current_through":"P.L. 38-133 (June 4, 2026)","vintage":"","retrieved_at":"2026-09-27T03:10:58Z","sha256":"f54fb2321c1c64d6f79c743bfc8afd96a69ef995816e91704297a307d4083433","source_id":"us-gu","stale":false,"prev":"us-gu/10-gca-95101","next":"us-gu/10-gca-95103"},"notice":"GroundRules: Original legal text.
