{"data":{"id":"us-gu/15-gca-5008","jurisdiction":"us-gu","citation":"15 GCA § 5008","heading":"Disclosure of Other Digital Assets of Deceased User.","body":"Unless the user prohibited disclosure of digital assets or the court directs otherwise, a custodian shall disclose to the personal representative of the estate of a deceased user a catalogue of electronic communications sent or received by the user and digital assets, other than the content of electronic communications, of the user, if the representative gives the custodian:\n(a) a written request for disclosure in physical or electronic form;\n(b) a certified copy of the death certificate of the user;\n(c) a certified copy of the letter of appointment of the representative or a small estate affidavit or court order; and\n(d) if requested by the custodian:\n(1) a number, username, address, or other unique subscriber or account identifier assigned by the custodian to identify the user’s account;\n(2) evidence linking the account to the user;\n(3) an affidavit stating that disclosure of the user’s digital assets is reasonably necessary for administration of the estate; or\n(4) a finding by the court that:\n(A) the user had a specific account with the custodian, identifiable by the information specified in Subparagraph (1); or\n(B) disclosure of the user’s digital assets is reasonably necessary for administration of the estate.","path":["Title 15: Estates and Probate","Division 4 - Guardian and Ward","Chapter 50: Revised Uniform Fiduciary Access to Digital Assets Act"],"source_url":"https://col.guamcourts.gov/sites/default/files/15gc050.pdf","current_through":"P.L. 38-133 (June 4, 2026)","vintage":"","retrieved_at":"2026-09-27T03:39:08Z","sha256":"b91c8202632634f2d50fb4ed56844c18ae99729d0fed69123fc812be536d4668","source_id":"us-gu","stale":false,"prev":"us-gu/15-gca-5007","next":"us-gu/15-gca-5009"},"notice":"GroundRules: Original legal text.
