The contract shall contain contractual obligations typically found in government of Guam construction contracts, including, but not limited to, the following:\n(a) all major subcontracts shall be covered by a performance bond;\n(b) the government of Guam and financing entities, or bondholders, shall be the named obligee under the bond;\n(c) the government of Guam shall have the sole right to call on the bid bond;\n(d) requirements to obtain performance and or payment bonds, indemnification, standard insurance specifications, technical building/construction specifications, construction progress schedule, applicable and or necessary maintenance schedules, and compliance with applicable rules, regulations, and Guam law; and\n(e) there shall be a specific delivery date with liquidated damages for failure to deliver the new Simon Sanchez High School by the specified date, which may include warranties for liquidated damages.","path":["Title 5: Government Operations","Division 5 - Public Works","Chapter 58D: Ma Kåhat Act of 2013"],"source_url":"https://col.guamcourts.gov/sites/default/files/05gc058D_Q.pdf","current_through":"P.L. 38-133 (June 4, 2026)","vintage":"","retrieved_at":"2026-09-27T02:24:38Z","sha256":"452b30d4190f28607507b237ea140e6c4e92dfc9de283fdbfa47f875034a86e1","source_id":"us-gu","stale":false,"prev":"us-gu/5-gca-58d105","next":"us-gu/5-gca-58d107"},"notice":"GroundRules: Original legal text.
