{"data":{"id":"us-gu/5-gca-6402","jurisdiction":"us-gu","citation":"5 GCA § 6402","heading":"Payments for Line Agency Obligations.","body":"(a) The Director of Administration shall pay from the Government Claims Fund for tort claims made against any line agency of the government, or the government of Guam in general, in order of the date of approved settlement or final judgment. In the event funds are insufficient to fully pay a claim, the claim shall be paid pro rata until the total claim is paid in full. All tort payments under this Chapter not made on account of the liability of autonomous agencies shall be made out of the Government Claims Fund only.\n(b) Payments pursuant to Subsection (a) of Section 6105 of Article 1 of Chapter 6 of Division 1 of Title 5, Guam Code Annotated, shall be paid from the funds certified for payment of the contract pursuant to the budget of the agency or appropriation against which the contract claim is made.\n(c) Payments pursuant to Subsection (b) of Section 6105 of Article 1 of Chapter 6 of Division 1 of Title 5, Guam Code Annotated, shall be paid from the Government Claims Fund.\n(d) Compensation for back wages shall come from the employee =s agency =s personnel budget and not from the Government Claims Fund.","path":["Title 5: Government Operations","Division 1 - Laws Applicable to Executive Branch","Chapter 6: Government Claims Act","ARTICLE 4: PAYMENTS"],"source_url":"https://col.guamcourts.gov/sites/default/files/5gc006.pdf","current_through":"P.L. 38-133 (June 4, 2026)","vintage":"","retrieved_at":"2026-09-27T02:17:28Z","sha256":"cc00744f0ae991246cc7119fbec9e3a156bdec2f79fc9bc31076148ae6a0de22","source_id":"us-gu","stale":false,"prev":"us-gu/5-gca-6401","next":"us-gu/5-gca-6403"},"notice":"GroundRules: Original legal text.
