{"data":{"id":"us-gu/7-gca-53102","jurisdiction":"us-gu","citation":"7 GCA § 53102","heading":"Definitions.","body":"As used in this Chapter, the term:\n(a) child means an unemancipated individual who is less than eighteen (18) years of age;\n(b) consent means affirmative, conscious, and voluntary authorization by an individual with legal capacity to give authorization;\n(c) depicted individual means an individual whose body is shown in whole or in part in an intimate image;\n(d) dis closure means transfer, publication, or distribution to another person; and disclose has a corresponding meaning;\n(e) harm means physical harm, economic harm, or emotional distress whether or not accompanied by physical or economic harm;\n(f) identifiable means recognizable by a person other than the depicted individual:\n(1) from an intimate image itself; or\n(2) from the intimate image and identifying characteristic displayed in connection with the intimate image;\n(g) identifying characteristic means information that may be used to identify a depicted individual;\n(h) individual means a human being.\n(i) intimate image means a photograph, film, video recording, or other similar medium that shows:\n(1) the uncovered genitals, pubic area, anus, or female post-pubescent nipple of a depicted individual; or\n(2) the depicted individual engaging in or being subjected to sexual conduct.\n(j) parent means an individual recognized as a parent under Guam law.\n(k) person means an individual, estate, business or nonprofit entity, public corporation, government or governmental subdivision, agency or instrumentality, or other legal entity;\n(l) private means:\n(1) created or obtained under circumstances in which the depicted individual had a reasonable expectation of privacy; or\n(2) made accessible through theft, bribery, extortion, fraud, false pretenses, voyeurism, or exceeding authorized access to an account, message, file, device, resource, or property;\n(m) sexual conduct includes:\n(1) masturbation;\n(2) genital, anal, or oral sex;\n(3) sexual penetration of, or with, an object;\n(4) bestiality; or\n(5) the transfer of semen onto a depicted individual.","path":["Title 7: Judiciary and Civil Procedure","Division 3 - Civil Special Proceedings","Chapter 53: The Guam Uniform Civil Remedies for Unauthorized Disclosure of Intimate Images Act of 2019"],"source_url":"https://col.guamcourts.gov/sites/default/files/7gc053.pdf","current_through":"P.L. 38-133 (June 4, 2026)","vintage":"","retrieved_at":"2026-09-27T02:38:38Z","sha256":"487cf5b82a9b407fdba9b24993df6484e017633a3ae04328718ea01e6c96c47b","source_id":"us-gu","stale":false,"prev":"us-gu/7-gca-53101","next":"us-gu/7-gca-53103"},"notice":"GroundRules: Original legal text.
