{"data":{"id":"us-gu/7-gca-53103","jurisdiction":"us-gu","citation":"7 GCA § 53103","heading":"Civil Action.","body":"(a) Except as otherwise provided in § 53104 of this Chapter, a depicted individual who is identifiable and who suffers harm from a person’s intentional disclosure or threatened disclosure of an intimate image that was private without the depicted individual’s consent has a cause of action against the person if the person knew or acted with reckless disregard for whether:\n(1) the depicted individual did not consent to the disclosure;\n(2) the intimate image was private; and\n(3) the depicted individual was identifiable.\n(b) The following conduct by a depicted individual does not establish by itself that the individual consented to the disclosure of the intimate image which is the subject of the action or that the individual lacked a reasonable expectation of privacy:\n(1) consent to the creation of the image; or\n(2) previous consensual disclosure of the image.\n(c) A depicted individual who does not consent to sexual conduct or the uncovering of the part of the body depicted in the intimate image of the individual retains a reasonable expectation of privacy even if the image was created when the individual was in a public place.\n(d) This Section is not the exclusive remedy for an intentional disclosure or threatened disclosure of an intimate image, and a plaintiff may also bring any other available common law or statutory claims.","path":["Title 7: Judiciary and Civil Procedure","Division 3 - Civil Special Proceedings","Chapter 53: The Guam Uniform Civil Remedies for Unauthorized Disclosure of Intimate Images Act of 2019"],"source_url":"https://col.guamcourts.gov/sites/default/files/7gc053.pdf","current_through":"P.L. 38-133 (June 4, 2026)","vintage":"","retrieved_at":"2026-09-27T02:38:38Z","sha256":"64fcc8de6e9a8f094d3305e93f5603416b3a0320c383c7897abd2b278f024898","source_id":"us-gu","stale":false,"prev":"us-gu/7-gca-53102","next":"us-gu/7-gca-53104"},"notice":"GroundRules: Original legal text.
