{"data":{"id":"us-gu/9-gca-46.405","jurisdiction":"us-gu","citation":"9 GCA § 46.405","heading":"Violations.","body":"(a) A person who violates this Act is guilty of a third degree felony, and is subject to a fine not to exceed Five Thousand Dollars ($5,000), or imprisonment not to exceed five (5) years, or both.\n(b) The following persons may bring a civil action against a person who violates this Act:\n(1) an internet service provider who is adversely affected by the violation;\n(2) an owner of a webpage, computer server, or a trademark that is used without authorization in the violation; or\n(3) the Attorney General.\n(c) Except as provided by paragraph 3, a person permitted to bring a civil action may obtain either actual damages for a violation of this Act, or a civil penalty not to exceed One Hundred Fifty Thousand Dollars ($150,000) per violation of this Act.","path":["Title 9: Crimes and Corrections","Chapter 46: Forgery, Fraudulent Practices and Telephone Records","ARTICLE 4: ANTI-PHISHING ACT"],"source_url":"https://col.guamcourts.gov/sites/default/files/9gc046.pdf","current_through":"P.L. 38-133 (June 4, 2026)","vintage":"","retrieved_at":"2026-09-27T02:47:58Z","sha256":"16d613a0a8cb871131643293742d7b6fbc32bec4e52c32769ac6dba08ba42762","source_id":"us-gu","stale":false,"prev":"us-gu/9-gca-46.404","next":"us-gu/9-gca-46.406"},"notice":"GroundRules: Original legal text.
