Stat. § 134-21.5","heading":"Carrying of a firearm in the commission of a separate misdemeanor ; penalty.","body":"(a) It shall be unlawful for a person to knowingly carry on the person or have within the person's immediate control a firearm while engaged in the commission of a separate misdemeanor offense, whether the firearm was loaded or not, and whether operable or not; provided that a person shall not be prosecuted under this section when the separate offense is an offense otherwise defined by this chapter or is the offense of criminally negligent storage of a firearm under section 707-714.5.\n\n(b) A conviction and sentence under this section shall be in addition to and not in lieu of any conviction and sentence for the separate misdemeanor; provided that the sentence imposed under this section may run concurrently or consecutively with the sentence for the separate misdemeanor.\n\n(c) Any person violating this section shall be guilty of a class C felony.\n\n(d) For the purposes of this section, \"misdemeanor\" does not include a petty misdemeanor.","path":["HI Code","Division 1","Title 10","Chapter 134"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol03_Ch0121-0200D/HRS0134/HRS_0134-0021_0005.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"b3201f84e4d8c287152f97f1548fc0f36694776db4d278463b841b1c37e296e9","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-134-21","next":"us-hi/haw.-rev.-stat.-134-22"},"notice":"GroundRules: Original legal text.
