Stat. § 211D-1","heading":"Definitions.","body":"As used in this chapter, unless the context otherwise requires:\n\n\"Capital access loan\" means a loan that is entitled to be secured by the fund.\n\n\"Department\" means the department of business, economic development, and tourism.\n\n\"Financial institution\" includes a bank, trust company, banking association, savings and loan association, mortgage company, investment bank, credit union, or nontraditional financial institution.\n\n\"Fund\" means the Hawaii capital loan revolving fund established in section 210-3.\n\n\"Loan\" includes a line of credit.\n\n\"Medium-sized business\" means a corporation, partnership, sole proprietorship, or other legal entity that:\n\n(1) Is domiciled in this State;\n\n(2) Is formed to make a profit; and\n\n(3) Employs one hundred or more but fewer than five hundred full-time employees.\n\n\"Nonprofit organization\" means a private, nonprofit, tax-exempt corporation, association, or organization listed in section 501(c)(3), Internal Revenue Code of 1986, as amended, that is domiciled in this State.\n\n\"Participating financial institution\" means a financial institution participating in the program.\n\n\"Program\" means the capital access program.\n\n\"Reserve account\" means an account established in a participating financial institution on approval of the department in which money is deposited to serve as a source of additional revenue to reimburse the financial institution for losses on loans enrolled in the program.\n\n\"Small business\" means a corporation, partnership, sole proprietorship, or other legal entity that:\n\n(1) Is domiciled in this State;\n\n(2) Is formed to make a profit;\n\n(3) Is independently owned and operated; and\n\n(4) Employs fewer than one hundred full-time employees.","path":["HI Code","Division 1","Title 13","Chapter 211D"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol04_Ch0201-0257/HRS0211D/HRS_0211D-0001.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"0b344c4bb742fdff54ae2d99824cb1ceedcddab6af1d6af9d9268d3b7014f4e8","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-210-8","next":"us-hi/haw.-rev.-stat.-211d-10"},"notice":"GroundRules: Original legal text.
