Stat. § 211D-3","heading":"Capital access program.","body":"(a) The department shall establish a capital access program to assist a participating financial institution in making loans to businesses and nonprofit organizations that face barriers in accessing capital.\n\n(b) The department shall use money in the fund to make a deposit in a participating financial institution's reserve account in an amount specified by this chapter to be a source of money the institution may receive as reimbursement for losses attributable to loans in the program.\n\n(c) The department shall determine the eligibility of a financial institution to participate in the program and may set a limit on the number of eligible financial institutions that may participate in the program.\n\n(d) To participate in the program, an eligible financial institution shall enter into a participation agreement with the department that sets out the terms and conditions under which the department will make contributions to the institution's reserve account and specifies the criteria for a loan to qualify as a capital access loan.\n\n(e) To qualify as a capital access loan, a loan shall:\n\n(1) Be made to a small or medium-sized business or to a nonprofit organization;\n\n(2) Be used by the business or nonprofit organization for any project, activity, or enterprise in Hawaii that fosters economic development; and\n\n(3) Meet any other criteria provided by this chapter.","path":["HI Code","Division 1","Title 13","Chapter 211D"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol04_Ch0201-0257/HRS0211D/HRS_0211D-0003.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"da46dcc1523b7909c1abe67822c892c9798536645166ee520ed10b86d7111f96","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-211d-2","next":"us-hi/haw.-rev.-stat.-211d-4"},"notice":"GroundRules: Original legal text.
