Stat. § 291C-195","heading":"Driving of mopeds.","body":"(a) Notwithstanding section 286-81(b), no person:\n\n(1) Less than sixteen years of age shall drive a moped on a highway, street, or roadway, or any other public property in the State; and\n\n(2) Shall drive a moped unless the person wears a safety helmet securely fastened with a chin strap.\n\nThe safety helmet shall meet the specifications and requirements established by rules adopted by the director.\n\n(b) No person shall drive a moped except while sitting astride the seat, facing forward, with one leg on each side of the moped.\n\n(c) No person shall drive a moped which is carrying any other person nor shall any person other than the driver ride upon a moped.\n\n(d) Subsections (b) and (c) shall not apply to three-wheeled mopeds designed to carry a driver and passenger seated side by side.\n\n(e) Three-wheeled mopeds shall be insured for liability and property damage, excluding personal injury protection.","path":["HI Code","Division 1","Title 17","Chapter 291C"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol05_Ch0261-0319/HRS0291C/HRS_0291C-0195.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"08090b2c163c31f53cd9ab2d3d74a2b0c11e47ca5ddda93bb4dc985e628fcb58","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-291c-194","next":"us-hi/haw.-rev.-stat.-291c-196"},"notice":"GroundRules: Original legal text.
