Stat. § 291E-20","heading":"Minimum standards for roadblock procedures.","body":"(a) Every intoxicant control roadblock program shall:\n\n(1) Require that all vehicles approaching roadblocks be stopped or that certain vehicles be stopped by selecting vehicles in a specified numerical sequence or pattern;\n\n(2) Require that roadblocks be located at fixed locations for a maximum three-hour period;\n\n(3) Provide for the following minimum safety precautions at every roadblock:\n\n(A) Proper illumination;\n\n(B) Off-road or otherwise safe and secure holding areas for vehicles involved in any roadblock stop;\n\n(C) Uniformed law enforcement officers carrying proper identification;\n\n(D) Adequate advance warning of the fact and purpose of the roadblocks, either by sign posts, flares, or other alternative methods;\n\n(E) Termination of roadblocks at the discretion of the law enforcement officer in charge where traffic congestion would otherwise result; and\n\n(4) Provide for a sufficient quantity and visibility of uniformed officers and official vehicles to ensure speedy compliance with the purpose of the roadblocks and to move traffic with a minimum of inconvenience.\n\n(b) Nothing in this section shall prohibit the establishment of procedures to make roadblock programs less intrusive than required by the minimum standards provided in this section.","path":["HI Code","Division 1","Title 17","Chapter 291E"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol05_Ch0261-0319/HRS0291E/HRS_0291E-0020.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"060d32c1a139a2538e7b2aff87caf8a49fe7a7c66d51e9b0eadb3095401b5f74","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-291e-2","next":"us-hi/haw.-rev.-stat.-291e-21"},"notice":"GroundRules: Original legal text.
