Stat. § 291E-4","heading":"Convictions and acts prior to January 1, 2002.","body":"(a) Any:\n\n(1) Conviction for an offense under section 200-81, 291-4, 291-4.4, or 291-7 as those sections were in effect on December 31, 2001;\n\n(2) Conviction in any other state or federal jurisdiction for an offense that is comparable to operating or being in physical control of a vehicle while having either an unlawful alcohol concentration or an unlawful drug content in the blood or urine or while under the influence of an intoxicant; or\n\n(3) Adjudication of a minor for a law violation that, if committed by an adult, would constitute a violation of section 200-81, 291-4, 291-4.4, 291-4.5, or 291-7 as those sections were in effect on December 31, 2001;\n\nshall be counted as a prior offense for purposes of section 291E-41, 291E-61, or 291E-61.5.\n\n(b) Any conviction of an offense under section 291-4, 291-4.4, 291-4.5, or 291-7 as those sections were in effect on December 31, 2001, shall be counted for purposes of imposing sentence for a violation under section 291E-62.","path":["HI Code","Division 1","Title 17","Chapter 291E"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol05_Ch0261-0319/HRS0291E/HRS_0291E-0004.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"43a60c99a2eb68e4c645aac81360b1f7a739c9326bbdcc1b44d02e4311d4c647","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-291e-39","next":"us-hi/haw.-rev.-stat.-291e-40"},"notice":"GroundRules: Original legal text.
