Stat. § 353-16.2","heading":"Transfer of inmates to out-of-state institutions.","body":"(a) The director may effect the transfer of a committed felon to any correctional institution located in another state regardless of whether the state is a member of the Western Interstate Corrections Compact; provided that the institution is in compliance with appropriate health, safety, and sanitation codes of the state, provides a level of program activity for the inmate that is suitable, and is operated by that state, by any of its political subdivisions, or by a private institution; and provided further that the transfer is either:\n\n(1) In the interest of the security, management of the correctional institution where the inmate is presently placed, or the reduction of prison overcrowding; or\n\n(2) In the interest of the inmate.\n\n(b) Terms and conditions of the transfer and any reimbursement for expenses shall be agreed upon between the department and the out-of-state correctional institution prior to transfer.","path":["HI Code","Division 1","Title 20","Chapter 353"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol07_Ch0346-0398/HRS0353/HRS_0353-0016_0002.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"f0a1d93caee4b3f958bb02053b1e7b8c4b76c99f8b933c7cbc267393d3776f6b","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-353-16","next":"us-hi/haw.-rev.-stat.-353-16.3"},"notice":"GroundRules: Original legal text.
