Stat. § 353-40","heading":"Correctional facility and community correctional center deaths; reporting.","body":"(a) Within forty-eight hours, the director shall report to the governor, and the governor shall report to the legislature, the death of any:\n\n(1) Correctional facility or community correctional center employee who:\n\n(A) Dies on the grounds of or while on duty at a correctional facility or community correctional center where Hawaii inmates reside; or\n\n(B) Sustains an injury on the grounds of or while on duty at a correctional facility or community correctional center where Hawaii inmates reside that causes the death of the employee; or\n\n(2) Hawaii inmate who is incarcerated by or under the care and custody of:\n\n(A) A state or contracted correctional facility; or\n\n(B) An agent of a state or contracted correctional facility.\n\nWithin seven days of the director's submission of the report to the governor, the department shall post a copy of the report on its public website.\n\n(b) The report in subsection (a) shall include the following information:\n\n(1) The name of the decedent;\n\n(2) The gender and age of the decedent;\n\n(3) Whether the decedent was an inmate or an employee;\n\n(4) The location of the death or injury leading to the death;\n\n(5) The date and time of the death;\n\n(6) The cause of death; and\n\n(7) Any indication of sexual assault leading to the death.\n\n(c) When the official cause of death has been determined, the director shall submit a report to the governor, and the governor shall submit the report to the legislature that shall include the following information:\n\n(1) The clinical mortality review conducted in response to the death, including correctional actions to be taken;\n\n(2) The official cause of death; and\n\n(3) Any indication of sexual assault leading to the death.\n\n(d) The information specified in subsection (c)(2) and (3) shall be open to public inspection, unless:\n\n(1) Any federal or state law protects the information from disclosure; provided that the report shall cite the applicable federal or state law; or\n\n(2) The disclosure of the information would materially impair an ongoing criminal investigation.","path":["HI Code","Division 1","Title 20","Chapter 353"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol07_Ch0346-0398/HRS0353/HRS_0353-0040.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"548ef277893fa1fa2daf9ae703c543cdedb3b686510f6f3d7368a4a244cd8010","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-353-39","next":"us-hi/haw.-rev.-stat.-353-41"},"notice":"GroundRules: Original legal text.
