Stat. § 37-52.3","heading":"Criteria for the establishment and continuance of special funds.","body":"Special funds shall be established only pursuant to an act of the legislature. The legislature, in establishing or reviewing a special fund to determine whether it should be continued, shall ensure that the special fund:\n\n(1) Serves a need, as demonstrated by:\n\n(A) The purpose of the program to be supported by the fund;\n\n(B) The scope of the program, including financial information on fees to be charged, sources of projected revenue, and costs; and\n\n(C) An explanation of why the program cannot be implemented successfully under the general fund appropriation process;\n\n(2) Reflects a clear nexus between the benefits sought and charges made upon the program users or beneficiaries or a clear link between the program and the sources of revenue, as opposed to serving primarily as a means to provide the program or users with an automatic means of support that is removed from the normal budget and appropriation process;\n\n(3) Provides an appropriate means of financing for the program or activity that is used only when essential to the successful operation of the program or activity; and\n\n(4) Demonstrates the capacity to be financially self-sustaining.","path":["HI Code","Division 1","Title 5","Chapter 37"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol01_Ch0001-0042F/HRS0037/HRS_0037-0052_0003.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"e70fa41a8b446e5d9d7434f57f22ae2691808ec7ba52ba1bac9149a10382a9b3","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-37-52","next":"us-hi/haw.-rev.-stat.-37-52.4"},"notice":"GroundRules: Original legal text.
