Stat. § 431:10C-315","heading":"Statute of limitations.","body":"(a) No suit shall be brought on any contract providing motor vehicle insurance benefits or any contract providing optional additional coverage more than the later of:\n\n(1) Two years from the date of the motor vehicle accident upon which the claim is based;\n\n(2) Two years after the last payment of motor vehicle insurance benefits;\n\n(3) Two years after the entry of a final order in arbitration;\n\n(4) Two years after the entry of a final judgment in, or dismissal with prejudice of, a tort action arising out of a motor vehicle accident, where a cause of action for insurer bad faith arises out of the tort action; or\n\n(5) Two years after payment of liability coverage, for underinsured motorist claims.\n\n(b) No suit arising out of a motor vehicle accident shall be brought in tort more than the later of:\n\n(1) Two years after the date of the motor vehicle accident upon which the claim is based;\n\n(2) Two years after the date of the last payment of motor vehicle insurance or optional additional benefits; or\n\n(3) Two years after the date of the last payment of workers' compensation or public assistance benefits arising from the motor vehicle accident.","path":["Hawaii Code","Division 2","Title 24","Chapter 431"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol09_Ch0431-0435H/HRS0431/HRS_0431-0010C-0315.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"15b88178a16b8aac70c3be49155f4264b7f6659bb60f743a48a320a0666ee4a8","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-431-10c-314","next":"us-hi/haw.-rev.-stat.-431-10c-402"},"notice":"GroundRules: Original legal text.
